    SeaWorld Accidents and Liability

With a decades-long history and locations open around the country, massive amusement chain SeaWorld has hosted over 145 million visitors since its debut in 1964. Several of these visitors experienced injuries while visiting the park.

In late 2012, for instance, 8-year-old Jillian Thomas sustained multiple puncture wounds to her hand while attempting to feed one of the park’s dolphins. According to Thomas’ mother, “They did not tell us to look out for any signs of infection. We had to ask for Band-Aids.” Thomas’ father alleges there were no disclaimers or warning signs posted.

Amusement parks are responsible for taking reasonable measures to safeguard their visitors. If such measures are not taken, or if hazards go ignored and uncorrected, the park may potentially be considered liable for any damages which may result to victims.

For example, if a park’s maintenance crew does not make the appropriate repairs to a ride, and that ride consequently malfunctions and injures a passenger, issues of liability may arise. In another example, if the property itself is not properly maintained — for example, if unsecured cables which should have been tied back cause a slip and fall accident — the park may again be potentially liable for resulting damages.

Slip and fall accidents are a serious health concern in the United States, particularly among the elderly. In fact, falls are the leading cause of fatal and non-fatal injuries to adults aged 65 and older, according to the CDC.

According to the Consumer Product Safety Commission, in 2006, amusement park injuries were divided almost evenly between children and adults, though children aged 10 to 14 represented just under 20% of all injuries requiring hospitalization.

Common Injuries Sustained at SeaWorld Amusement Park

    • Spinal Cord Injuries (SCI)
